Terms of Use

1. Welcome to 2 Shabd!

It is great to have you here. These Terms, along with the linked policies, govern your use of our services – the website (https://2shabd.com/), and related software or features (collectively referred to as the “Platform” or “2 Shabd”).

When we use terms like “we,” “our,” or “us” in these Terms, we are talking about Jaglen Platforms Pvt Ltd (CIN: U90009PN2024PTC234013). 2 Shabd is a product of Jaglen Platforms Pvt Ltd. By using 2 Shabd, you are agreeing to these Terms & Conditions (“Terms”) as well as the additional policies linked here and on the Platform. Please take the time to read these Terms carefully, and feel free to get in touch if you have any questions. If you do not agree with these Terms, please do not use 2 Shabd.

2. Changes to these Terms

2 Shabd is constantly evolving and improving. From time to time, we may make changes to the Platform or these Terms. We may need to change these Terms from time-to-time to reflect business updates, changes to the Platform (including if we decide to discontinue any functionality, features or part of the Platform), legal or commercial reasons, or otherwise to protect our legitimate interests. We can make these changes at any time and it is your responsibility to check these Terms now and then for any changes.

Your continued use of the Platform after any changes to the Terms is taken as your acceptance of the revised Terms. If you do not agree with the changes, we ask you to please stop using 2 Shabd and delete your account.

3. Your Account

To create an account and become a 2 Shabd user, you must be at least 13. If you are creating an account on behalf of someone else, you must have their permission to do so. You are responsible for your account and ensuring it is only used in a lawful manner. When you create an account, you agree to comply with these Terms and that you are over 13 and legally able to enter these Terms with us. You must provide us with accurate info about yourself — if anything changes, please make the necessary changes under your account settings.

If you are using 2 Shabd on behalf of a business or individual, you confirm that you are authorized by them to agree to these Terms on their behalf. You are responsible for anything that happens to your account, so keep your login credentials safe and do not share them with anyone.

If you think your account has been compromised, please contact us immediately. You must not assign or transfer your account to someone else or use your account (or allow it to be used by anyone) in a way which in our reasonable opinion, causes damage to 2 Shabd or our reputation, or infringes another's rights or applicable laws and regulations.

4. Your Username

When you create a profile, you will need to choose a suitable username that respects everyone's rights. We understand your username holds significance, but it must also be appropriate for all users and avoid infringing on anyone's rights, including intellectual property (IP) rights like copyright and trademarks. You cannot use someone else's name, like a celebrity or brand, or pick a username that's unrelated just to profit from it later (referred to as “Domain Squatting”).

If any issues arise with your username, we will assess the situation fairly and may ask you to change it. If you decline, we may suspend or delete your account. If someone claims your username violates their IP rights, they must file an Intellectual Property report, and you will have the chance to respond with a Counter Notice. If you have not logged in, have not approved new reviews for your profile, or have not submitted a new review to someone's profile for the past 12 months, we might reclaim or reassign your username (but we will always contact you first).

5. Your Content

Users may provide and receive reviews from followers, friends, family, colleagues, and other people regarding shared experiences, life moments, or social connections. It is solely the user's responsibility to approve or deny any submitted reviews before they appear on their profile.

• User Responsibility: You agree that all content, including reviews, photos, and other materials shared on 2 Shabd, must not violate the rights of any third party, including copyright, privacy, or other personal or proprietary rights.
• Content Approval: Users must manually approve reviews for them to be displayed on their profile. If a user approves a review, they are fully responsible for any consequences that may arise from the visibility of the review to others.
• Content Moderation: 2 Shabd does not review or pre-moderate reviews submitted by others. If a user submits content that goes against our Community Standards, it is the receiving user's responsibility to deny that content and report it to 2 Shabd. By signing up for 2 Shabd, users acknowledge that such scenarios may occur and agree to proactively deny and report offensive reviews.
• Reporting Inappropriate Content: Users are encouraged to report any reviews that violate 2 Shabd's Community Standards guidelines.
• No Responsibility After Approval: Once a review has been approved and published on a user's profile, 2 Shabd assumes no responsibility for any consequences or outcomes that may occur due to its visibility. By publishing a review, the user agrees that they have reviewed and accepted the content, and any potential reactions from others are outside 2 Shabd's control.
• Responsibility for Third-Party Content: Users have direct and exclusive control over the content posted to their individual profiles. This includes, but is not limited to, text, images, and screenshots of third-party platforms (e.g., WhatsApp, Instagram, Google Maps). 2 Shabd does not pre-screen, monitor, or verify this content.
• Indemnification: By posting third-party content, the user represents and warrants that they have obtained all necessary permissions from the original content owner. The user agrees to indemnify and hold 2 Shabd harmless from any claims, including copyright or privacy violations, arising from such posts.
• SEO & Search Visibility Warning: 2 Shabd provides a platform for expression but does not guarantee search engine performance. Users are hereby notified that posting non-original content, such as screenshots of text or verbatim copies of reviews from external platforms, may be flagged as "duplicate" or "static" data by search engines like Google. This can lead to a significant degradation of the user’s page rank and overall search visibility.

By submitting content on 2 Shabd, you agree that:

• You own the rights to the content shared or have received permission from the content owner to share it.
• Other users may view your reviews for motives related to friendship, dating, matrimonial, roommate search, etc.

We love the variety of content that our users post on 2 Shabd! However, we want to ensure that everyone who visits the Platform can do so safely – that’s why we have our Community Standards. These standards set out what content is and isn’t allowed on 2 Shabd, so please make sure you follow them, otherwise we may suspend or permanently remove your account.

Community Standards: You agree to avoid from engaging in:

• hate speech, spamming, or harassing.
• doing fraudulent activities, advertising, encouraging, or facilitating the sale of regulated or illegal goods, services, or activities.
• endorsing child harm or self-harm.
• uploading content that violates someone’s copyrights or trademarks.
• spreading misinformation

When we talk about your “content”, we mean the text, graphics, videos, links, products and any other materials you add to your profile. You’re responsible for your content and you warrant that:

• The content you post is yours, or if you’re using third-party materials, you have the necessary rights to share them on 2 Shabd (and allow us to use them as per these Terms)
• Your content will not infringe on anyone’s privacy, publicity, intellectual property, or any other rights.
• Your content is accurate and honest: it shouldn’t be misleading, deceptive, or violate any laws, and it shouldn’t harm our reputation.
• Your content is free from harmful elements like viruses or disruptive code that could damage the Platform or other systems.
• Your content doesn’t contain automated collection tools: do not use scripts or scraping tools to gather information from profiles or the Platform.
• You will refrain from posting unauthorized ads on 2 Shabd.
• Your content aligns with our Community Standards.

Since laws and regulations can differ across the countries we operate in, we might ban content that is considered legal in some regions but not others. We reserve the right to take appropriate steps to keep 2 Shabd safe, including content removal or access restriction.

6. What we can do with Your Content

We love your content and want to show it off. Keep in mind that by default your content will be private and will be accessible only to people in your inner and outer circles. However, if you convert your profile from Personal to Public, it may be used and re-shared by others on 2 Shabd and across the internet. Even in Public mode, you can control per review visibility.

When you accept reviews for your profile with Public mode, you grant us a license to (i) use, publicly display, distribute, modify, adapt and create derivative works of such content; and (ii) use your name, image, voice, photograph, likeness and any other personal attributes in the content; on the Platform and in our marketing in all media (such as our social channels and any other advertising). This license is worldwide, royalty-free and perpetual, which means we can use your content anywhere in the world, without paying you fees, for as long as we like. You agree that you have all third-party rights necessary to post the content on 2 Shabd and to grant us this license. This license is also applicable for reviews that were kept public in the Public mode, but later kept within a Circle privacy, when switching to a Personal mode.

Please do not share personal information on 2 Shabd that you do not want visible to the world. Never post social security numbers, passport details or similar information that could cause harm in the wrong hands. You may only post another person's personal information where you have their consent and have kept a record of it. We do not have to monitor the accuracy, reliability or legality of your content, but we may choose to do so.

We may modify, remove or restrict access to content at any time in line with these Terms.

7. Suspension or cancellation of your Account

If you do not follow these Terms, or Community Standards or any other linked policies we might need to suspend or cancel your account, or take other action regarding your account or adjust how the Platform works for you.

The steps we take will depend on the nature of the non-compliance. In some cases, we might not resort to suspending or canceling your account. However, if there’s a repeated or significant non-compliance, we’re more likely to consider those measures. In the event that we do suspend or cancel your account, we usually aim to notify you beforehand, although we’re not obligated to do so.

We won’t be responsible for any content that is lost as a result of your account being suspended, or canceled.

If you believe your account was mistakenly canceled or if you encounter issues with these Terms or the Platform, please get in touch with us at support@2shabd.com. We’re committed to making good-faith efforts to resolve the matter, and neither party will initiate legal action concerning the issue until we’ve spent at least one month working together to find a resolution.

8. Your responsibility for your visitors and circles

You are responsible for your profile visitors, which includes circles (both inner and outer) who can view your profile and submit reviews to you profile, or anyone else (Public mode) – collectively known as “End Users.” You bear the sole responsibility for (i) how End Users engage with your profile and content, and (ii) ensuring compliance with all applicable laws concerning your End Users. 2 Shabd is not responsible for any products or services advertised or sold via 2 Shabd.

9. Feedback

We love hearing your ideas on how we can make 2 Shabd even better! Sometimes, we may make “beta” functionality available to you and seek your feedback. Keep in mind that if you share feedback with us, we’re free to use it however we like, without payment to you (or to not use it at all). We may from time to time make certain functionality of the Platform available to you in “beta” (or similar).

You acknowledge that we are still evaluating and testing such beta functionality and it may not be as reliable as other parts of the Platform.

10. Our Platform

We, as the owners of the Platform, grant you a limited right to use it for exchanging content and writing content for other users. However, please note that we are not responsible for any content, products, or services made available through other users’ profiles. All rights, including Intellectual Property (IP) Rights, related to the Platform (excluding your content) (referred to as “2 Shabd IP”), are exclusively owned by 2 Shabd or our licensors. You do not acquire any rights in the 2 Shabd IP, and you are not allowed to use it, including our brand name or logo, for any purpose without our prior written approval, such as implying a partnership or endorsement from 2 Shabd.

As a user, we grant you a limited, revocable, non-exclusive, and non-transferable right to use the Platform for creating, displaying, using, playing, and uploading content in accordance with these Terms.

If we provide you with images, icons, themes, fonts, videos, graphics, or other content, please only use them on your profile and in line with any guidelines we make available to you. Please do not remove, hide, or alter any proprietary notices or trademarks on the Platform. Copying, reproducing, distributing, licensing, selling, reselling, modifying, translating, disassembling, decompiling, decrypting, reverse-engineering, or attempting to derive the source code of the Platform or any part of it is strictly prohibited.

When you visit profiles as a “profile visitor” with proper profile access, we grant you a limited, non-exclusive, and non-transferable right to view and interact with the Platform through user profiles. To the extent allowed by law, we are not responsible for any opinions, advice, statements, products, services, offers, or other content posted by other users on their profiles.

11. Fees and Payment

No Fees: 2 Shabd user-owned (created via Gmail ID or Apple ID) portfolios are free to use.

Donation: You acknowledge that any donations that you may provide are given voluntarily to support the Platform, without expectation of any goods or services in return.

12. International Data Transfers and User Consent

2 Shabd is available to users worldwide. You are responsible for ensuring that your use of our services complies with the laws of your country, including data protection, intellectual property, and online conduct laws. By using 2 Shabd and its services, you acknowledge and agree that your personal data may be transferred to and processed in countries outside of your country of residence, including countries that may not provide the same level of data protection as your home country.

• User Consent: You explicitly consent to the transfer of your data to countries outside of your jurisdiction by using 2 Shabd’s services. This may include transfers to third-party service providers and partners in countries where data protection laws may differ from those in your home country.
• Potential Risks: You understand and acknowledge that, by agreeing to this data transfer, your personal data may not be afforded the same legal protections as it would within your home jurisdiction. You accept the potential risks associated with such transfers and agree that 2 Shabd is not liable for any breach of privacy rights or security breaches that may occur due to differences in legal frameworks.
• Opt-out: If you do not agree to the international transfer of your personal data, you must refrain from using 2 Shabd. You may withdraw your consent at any time by contacting us; however, this may result in the termination of your account and access to our services.

13. Privacy

At 2 Shabd, safeguarding your privacy and that of your profile Visitors is our priority. Our Privacy Notice outlines how we handle your personal data for our internal purposes.

Our collection and use of personal data are described in our Privacy Notice. Nothing in these Terms removes any rights you may have in your personal data under applicable law. Platform software, branding, and other materials owned or licensed by us remain subject to our intellectual property rights.

14. Confidentiality

From time to time, we may share information with you that is confidential (e.g. we may reveal new and upcoming features to you if you take part in beta testing with us). If we share any confidential info with you, about 2 Shabd or the Platform, you must keep it secret and secure. You must also use reasonable measures to prevent others from accessing it. If you are participating in a Beta trial, and there is information we are comfortable with you sharing publicly as part of your participation, we will make that known to you.

15. Recommended Content

2 Shabd may suggest products or other content that may be interesting to you as a user of certain 2 Shabd features, or to your audience. 2 Shabd uses the data you provide or receive and the data 2 Shabd has about other users to make these recommendations. These recommendations are in no way an endorsement of the products or content by 2 Shabd.

16. Liability

We want to clarify that we are not responsible for how you use the Platform, and it’s crucial that you maintain backups of your own content. We are not liable for any damages resulting from actions such as downloading, installing, or utilizing the Platform, or even copying, distributing, or downloading content from it. It’s on you to ensure your data, content, and devices are adequately protected and backed up while using the Platform.

You agree to protect us from any losses that arise if you breach these Terms or if a third party raises a claim against us related to your content. Neither of us will be liable for indirect, punitive, special, incidental, or consequential damages. These might include losses in business, revenue, profits, privacy, data, goodwill, or other economic benefits. This applies whether the issue stems from a contract breach, negligence, or any other cause—even if we were aware of the potential for such damages.

You agree to indemnify and hold 2 Shabd, its affiliates, officers, directors, employees, and agents harmless from any claims, liabilities, damages, or expenses, including reasonable attorneys' fees, arising out of your use of the site, your violation of these Terms, or your violation of any third-party rights.

Our liability to you under these Terms or related to the Platform will not go beyond INR 100.

17. Disclaimers

We want to make a few important disclaimers within these terms. When you use 2 Shabd and explore any content on the Platform, you’re doing so at your own risk.

2 Shabd provides a platform for users to share reviews about their life experiences. However, 2 Shabd does not guarantee the accuracy, reliability, or appropriateness of the content submitted by users. The content displayed on each user’s profile is based on the user's decision to approve or deny reviews, and 2 Shabd does not assume responsibility for the views, opinions, or interactions shared through these reviews.

Users understand and agree that:

• They may encounter content that could be objectionable, offensive, or inappropriate.
• It is their responsibility to manage, moderate, and report such content.
• 2 Shabd cannot be held liable for any emotional, social, or legal consequences arising from the publication of approved reviews or interactions with other users.

2 Shabd disclaims all liability for any direct, indirect, incidental, or consequential damages resulting from the use of the website, including but not limited to any content or reviews displayed on user profiles.

The Platform is provided to you “AS IS” and “AS AVAILABLE”, without any warranties of any kind, whether they’re express or implied, including (but not limited to), up-time or availability, or any implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

2 Shabd, its affiliates and its licensors do not make any express or implied warranties or representations, including that:

• the Platform will function uninterrupted, securely or be available at any time or place;
• any errors or defects will be corrected;
• the Platform is free of viruses or other harmful components;
• the Platform is effective or the results of using the Platform will meet your needs; or
• any content on the Platform (including any user content) is complete, accurate, reliable, suitable or available for any purpose.

These Terms apply to the maximum extent permitted by law and nothing in them is intended to exclude, restrict or modify legal rights that you may have, which cannot be excluded, restricted or modified by contract. If these Terms are governed by the Indian Consumer Law, our liability to you for not complying with a consumer guarantee is limited to re-supply of the services.

18. Third Party Services

Currently, 2 Shabd has not integrated any third-party services.

19. Open-Source

The website includes open-source software components, and some of these components are subject to their own specific license terms. If the license terms of a particular open-source component do not align with our terms outlined here, then these Terms won’t cover that component. Instead, the relevant license terms will govern your rights and responsibilities for that specific component.

20. Behavioral Competency Reports (BCRs) and Review Integrity

2 Shabd may allow users to submit reviews for consideration in a Behavioral Competency Report (BCR). For each semester, the intended BCR composition is limited to four reviews: one self-review, two peer reviews, and one supervisor review. All relevant accounts must be verified [Account Verification]. Submission does not guarantee that a review will be accepted or included; an authorized psychologist assesses whether the observation is suitable for the BCR. See the Review Writing Guidelines for the required format and examples.

When submitting a review for BCR consideration, you must identify whether it is a self-review or a review written by another user and correctly classify the reviewer as a peer or supervisor. A user who has supervisor status may be designated as a peer for a particular review only where the submission process permits it and a separate eligible supervisor review is also designated, so the required BCR composition is maintained. Reviewer classifications must be truthful and must not be used to bypass eligibility or review limits.

You must not fabricate observations, submit reviews on another person's behalf without authorization, coordinate misleading or reciprocal reviews, manipulate reviewer classifications, or attempt to influence a psychologist's assessment. Reviews should describe specific behavior you actually observed. We may reject or remove submissions, restrict review or supervisor features, or suspend accounts in accordance with these Terms and applicable law where we reasonably identify abuse or material non-compliance.

Approved reviews submitted for BCR consideration may be displayed on home pages of users within the subject's college even if a different visibility setting was assigned to the review. Profile-page visibility may continue to follow the review's assigned settings. The interpreted BCR itself is intended to remain confidential and is not made public merely because a source review is displayed. Details of this visibility and the associated personal-data processing are set out in the Privacy Notice.

21. Supervisor Role and Eligibility

Eligible supervisor applicants may include faculty members; college student-club office-bearers such as presidents, vice presidents, secretaries, and treasurers; and external industry or subject-matter experts, including internship mentors and alumni. Eligibility depends on the person's relationship to the relevant activity, ability to provide meaningful observations, and successful completion of the verification and approval process. This list describes possible applicant categories and does not guarantee approval.

Applicants must apply for the supervisor role [Supervisor Application] and provide the requested details, including a verifiable work or institutional email address where required. 2 Shabd may request additional information, verify the application, approve or decline it, and suspend or remove supervisor status if eligibility cannot be established or the role is misused. Applying for the role does not itself grant supervisor privileges.

Supervisors must submit honest, evidence-based observations grounded in their actual knowledge of or interaction with the person being reviewed. They must not invent observations, misrepresent their affiliation or expertise, disclose information they are not authorized to share, or participate in collusion. Further eligibility details and role responsibilities are described in the Supervisor Policy.

22. Review Guidelines and Related Policies

The Review Writing Guidelines and Supervisor Policy explain how to submit observations and apply for supervisor status. These documents supplement these Terms for the features they cover. If a guideline conflicts with these Terms, these Terms prevail unless the guideline expressly identifies a specific operational rule that is intended to govern that feature. We may update the guidelines as the Platform evolves; material changes to binding Terms will be handled under the Terms-change process above.

23. A few last things

Before you can start using 2 Shabd, there are a few last important points we’d like to address:

• Depending on your specific location, certain laws may apply to either you or us. In such cases, if these laws conflict with any portion of these Terms, the laws will prevail to the extent of the inconsistency.
• These Terms, including the Privacy Notice and any linked policies, constitute the full agreement between you and us regarding the Platform. We won’t add any other terms, except when the law mandates it. We explicitly exclude all implied terms, except those required by statute that cannot be waived. If any part of these Terms is deemed invalid under a country’s laws, it will be removed from the Terms in that country, but the rest of the Terms will remain in effect.
• These Terms are subject to the laws of India and the State of Maharashtra. Both you and we agree to the exclusive jurisdiction of the courts in those areas. Our decision not to insist on or enforce any part of these Terms won’t be seen as a waiver of any provision or right. These Terms, as well as the Platform, do not establish an agent/principal relationship between you and us.
• When you add an external content links such as YouTube Shorts, Instagram Reels, X’s tweets, etc., you are acknowledging your agreement to adhere to their terms and services.
